This Privacy Policy describes how z95labs collects, uses, and discloses Your information when You use the Service. It covers both the sign-up phase (applying to join the beta) and the beta participation phase (submitting manuscripts for evaluation).
We use Your Personal Data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.
Interpretation and Definitions
Interpretation
The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Account means a unique account created for You to access parts of our Service, including the beta participant dashboard.

Business, for the purpose of CCPA/CPRA, refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers' personal information, that does business in the State of California.

CCPA and/or CPRA refers to the California Consumer Privacy Act (the "CCPA") as amended by the California Privacy Rights Act of 2020 (the "CPRA").

Company (referred to as either "the Company", "We", "Us" or "Our" in this Privacy Policy) refers to ASMR Stories LLC, PO Box 71, North Bend, WA 98045.
For the purposes of the GDPR, the Company is the Data Controller.

Consumer, for the purpose of the CCPA/CPRA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.

Manuscript refers to the literary work You submit to the Service for evaluation during the beta participation phase.

Personal Data (or "Personal Information") is any information that relates to an identified or identifiable individual.
For the purposes of GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.
For the purposes of the CCPA/CPRA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
We use "Personal Data" and "Personal Information" interchangeably unless a law uses a specific term.

Service refers to the z95labs website and beta participant dashboard, accessible from https://z95labs.com.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
For the purposes of the GDPR, Service Providers are considered Data Processors.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Collecting and Using Your Personal Data
Types of Data Collected
Personal Data
We collect different categories of Personal Data depending on which phase of the Service You are using.
Sign-up phase (applying to join the beta):
- Email address
- First name and last name
- Country (self-attested by You; distinct from any country inferred from Your IP address)
- Application questionnaire answers
Beta participation phase (after acceptance into the beta cohort):
- Manuscript content that You submit for evaluation
- Evaluation outputs generated for Your Manuscript
- Communications between You and the Company (email, video office hours, and other channels established with the beta cohort)
- Dashboard interaction data
Usage Data
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device's unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
We may also collect information that Your browser sends whenever You visit Our Service or when You access the Service by or through a mobile device.
Tracking Technologies and Cookies
We use Cookies to track activity on Our Service and store certain information.
Where required by law, We use non-essential cookies (such as analytics cookies) only with Your consent. You can withdraw or change Your consent at any time using Your browser/device settings. Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal.
The specific cookies We use are:

Beta dashboard authentication cookies (essential, session). During the beta participation phase, We set session cookies to authenticate You into Your dashboard and keep You signed in. These are strictly necessary to provide the Service to beta participants.

Vercel session cookies. Our hosting provider, Vercel, sets cookies that support basic site functionality and security. These are described in Vercel's privacy policy.

PostHog analytics cookies. We use PostHog to understand how visitors and beta participants interact with the Service. PostHog sets cookies to identify unique sessions and track usage patterns. Where required by law, We obtain consent before setting these cookies.
We do not use advertising cookies, remarketing cookies, or cross-site tracking technologies.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain our Service, including to monitor the usage of our Service.
- To manage Your Account: to manage Your registration as a beta participant and to provide access to the beta participant dashboard.
- To provide manuscript evaluations: to process Your Manuscript through Our evaluation pipeline, including through Our AI processing partners, and to generate and deliver evaluation outputs to You.
- To communicate with You about the Service, Your application, Your evaluation, and the beta program. These communications are transactional. We do not send marketing newsletters or promotional emails.
- For the performance of a contract: the development, compliance and undertaking of any agreement You enter into with Us, including the Beta Participation Agreement.
- To manage Your requests: to attend and manage Your requests to Us, including data subject rights requests.
- For business transfers: We may use Your Personal Data to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
- For other purposes: to detect and prevent security incidents, fraud, and abuse; to comply with legal obligations; and to evaluate and improve Our Service.
We may share Your Personal Data in the following situations:
- With Service Providers: We share Your Personal Data with the Service Providers listed in the "Service Providers" section of this Privacy Policy. Each Service Provider operates under contractual obligations consistent with this Privacy Policy.
- For business transfers: We may share or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
- To comply with legal obligations: as described in the "Disclosure of Your Personal Data" section.
- With Your consent: We may disclose Your Personal Data for any other purpose with Your consent.
Manuscript Handling
Manuscripts submitted to the Service receive heightened protection. The commitments in this section are binding and mirror the promises made in Our public FAQ.

No training on submitted content. Your Manuscript is never used to train Our models or those of Our AI processing partners. We work only with AI providers whose terms prohibit training on submitted content.

No sharing outside z95labs and named processing partners. Your Manuscript is processed only by the Company and the AI processing partners disclosed in the "Service Providers" section. It is not shared with anyone else.

Zero or short retention with AI processing partners. Our AI processing partners operate under terms that require zero or short retention of submitted content. Your Manuscript is not stored on their systems beyond what is necessary to generate Your evaluation.

Delete button in the dashboard. Your beta participant dashboard provides a delete button that lets You remove Your Manuscript from Our systems at any time, before, during, or after evaluation.

30-day deletion on request. If You prefer to make a request by email at shyam@z95labs.com, We will delete Your Manuscript within 30 days of receiving Your request.
Service Providers
We use the following Service Providers to operate the Service. Each is engaged under contractual terms consistent with this Privacy Policy.
Used in both the sign-up and beta phases:

Used only in the beta participation phase:

- OpenAI (AI processing for manuscript evaluation; paid-tier API operating under no-training and zero or short-retention terms). Privacy policy: https://openai.com/policies/privacy-policy
We may add or replace AI processing providers over time. Any provider We use will meet the same standards: no training on submitted content, and zero or short retention of submitted content. We will update this section when changes occur.
Retention of Your Personal Data
The Company retains Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.
We apply different retention periods to different categories of Personal Data:

Sign-up data (email, name, country, application answers): retained until You request deletion OR until the next invitation round, whichever comes first. If You are not invited into a beta cohort, Your sign-up data is deleted at the next-round cutoff unless You request earlier deletion.

Beta participant account data (dashboard account, login records): retained for the duration of Your beta participation, plus up to 24 months after the beta relationship ends for dispute resolution and to defend legal claims.

Manuscript content: retained only during the evaluation period. Deleted via the dashboard delete button at any time, or within 30 days of a written request to shyam@z95labs.com.

Evaluation outputs: retained for the duration of Your beta participation. Deletable on request.

Communications between You and the Company: retained for the duration of Your beta participation plus up to 24 months after the beta relationship ends.

Usage Data (PostHog analytics, Vercel logs, IP addresses, device identifiers): up to 24 months from the date of collection.
We may retain Personal Data beyond these periods where required for:
- Legal obligations (for example, financial records for tax authorities)
- Establishing, exercising, or defending legal claims
- Backup retention, where residual copies remain in encrypted backups for a limited period consistent with our backup retention schedule
- Anonymization, where We convert Personal Data into anonymous statistical data that cannot be linked back to You
You may request information about how long We will retain Your Personal Data by contacting Us.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from Your jurisdiction.
Where required by applicable law, We will ensure that international transfers of Your Personal Data are subject to appropriate safeguards and supplementary measures where appropriate. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.
Delete Your Personal Data
You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.
Beta participants may delete Manuscript content directly from their dashboard at any time using the delete button.
For other Personal Data, You may contact Us at shyam@z95labs.com to request access, correction, or deletion of Your Personal Data. We will respond within 30 days for general data subject requests. Statutory CCPA/CPRA timelines apply where relevant (see the CCPA/CPRA section below).
Please note that We may need to retain certain information when We have a legal obligation or lawful basis to do so.
Disclosure of Your Personal Data
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
Law enforcement
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
Other legal requirements
The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:
- Comply with a legal obligation
- Protect and defend the rights or property of the Company
- Prevent or investigate possible wrongdoing in connection with the Service
- Protect the personal safety of Users of the Service or the public
- Protect against legal liability
Security of Your Personal Data
The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially reasonable means to protect Your Personal Data, We cannot guarantee its absolute security.
Transactional Email
We use email to communicate with You about the Service. These communications are transactional and include:
- Application status updates
- Beta invitation and onboarding
- Evaluation delivery and follow-up
- Account and security notifications
- Responses to Your requests
We do not send marketing newsletters or promotional emails. Email is delivered through Resend, our transactional email Service Provider.
GDPR Privacy
Legal Basis for Processing Personal Data under GDPR
We may process Personal Data under the following conditions:
- Consent: You have given Your consent for processing Personal Data for one or more specific purposes.
- Performance of a contract: Provision of Personal Data is necessary for the performance of an agreement with You and/or for any pre-contractual obligations thereof.
- Legal obligations: Processing Personal Data is necessary for compliance with a legal obligation to which the Company is subject.
- Vital interests: Processing Personal Data is necessary in order to protect Your vital interests or of another natural person.
- Public interests: Processing Personal Data is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Company.
- Legitimate interests: Processing Personal Data is necessary for the purposes of the legitimate interests pursued by the Company.
In any case, the Company will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.
International Transfer of Personal Data
We may transfer, store, and process Personal Data in countries other than the country in which You are located, including countries outside the European Economic Area ("EEA") and the United Kingdom ("UK"), where data protection laws may differ.
Where We transfer Personal Data outside the EEA/UK to a country that has not been recognized as providing an adequate level of protection, We rely on appropriate safeguards, such as:
- The European Commission's Standard Contractual Clauses ("SCCs") and/or the UK International Data Transfer Agreement ("IDTA") or the UK Addendum to the SCCs (as applicable)
- Supplementary measures where appropriate, such as encryption in transit and at rest, access controls, data minimisation, and vendor security reviews.
We transfer Personal Data internationally only as needed to provide the Service and to work with our Service Providers (for example, hosting, analytics, email delivery, AI processing). You may contact Us using the details in the "Contact Us" section of Our Privacy Policy to request further information about the safeguards We use for international transfers, including copies of relevant contractual protections (redacted where necessary).
Your Rights under the GDPR
The Company undertakes to respect the confidentiality of Your Personal Data and to guarantee You can exercise Your rights.
You have the right under this Privacy Policy, and by law if You are within the EU, to:
- Request access to Your Personal Data. The right to access, update or delete the information We have on You. Beta participants can access and delete certain Personal Data directly from their dashboard. For other requests, please contact Us.
- Request restriction of processing. You have the right to ask Us to restrict processing of Your Personal Data in certain circumstances (for example, while We verify accuracy or consider an objection).
- Request correction of the Personal Data that We hold about You. You have the right to have any incomplete or inaccurate information We hold about You corrected.
- Object to processing of Your Personal Data. This right exists where We are relying on a legitimate interest as the legal basis for Our processing and there is something about Your particular situation, which makes You want to object to our processing of Your Personal Data on this ground.
- Request erasure of Your Personal Data. You have the right to ask Us to delete or remove Personal Data when there is no good reason for Us to continue processing it.
- Request the transfer of Your Personal Data. We will provide to You, or to a third-party You have chosen, Your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which You initially provided consent for Us to use or where We used the information to perform a contract with You.
- Withdraw Your consent. You have the right to withdraw Your consent on using Your Personal Data. If You withdraw Your consent, We may not be able to provide You with access to certain specific functionalities of the Service.
Exercising of Your GDPR Data Protection Rights
You may exercise Your rights of access, rectification, cancellation and opposition by contacting Us at shyam@z95labs.com. Please note that We may ask You to verify Your identity before responding to such requests. We commit to responding to general data subject requests within 30 days.
You have the right to complain to a Data Protection Authority about Our collection and use of Your Personal Data. For more information, if You are in the European Economic Area (EEA), please contact Your local data protection authority in the EEA.
CCPA/CPRA Privacy Notice (California Privacy Rights)
This privacy notice section for California residents supplements the information contained in Our Privacy Policy and it applies solely to all visitors, users, and others who reside in the State of California.
Categories of Personal Information Collected
We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or Device. The following is a list of categories of personal information which We may collect or may have been collected from California residents within the last twelve (12) months.

Examples: A name, signature, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.
Collected: Limited overlap with Category A only (first and last name). We do not collect signature, physical characteristics, telephone number, financial information, medical information, or health insurance information.
- Category C: Protected classification characteristics under California or federal law.
Examples: Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).

- Category D: Commercial information.
Examples: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

- Category E: Biometric information.
Examples: Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.

- Category F: Internet or other similar network activity.
Examples: Browsing history, search history, information on a consumer's interaction with a website, application, or advertisement.
Collected: Yes (interaction with the Service, dashboard activity, page views).
- Category G: Geolocation data.
Examples: Approximate physical location, physical location or movements.
Collected: No precise geolocation. Approximate location may be inferred from IP address by Our analytics provider.
- Category H: Sensory data.
Examples: Audio, electronic, visual, thermal, olfactory, or similar information.
Collected: No.
- Category I: Professional or employment-related information.
Examples: Current or past job history or performance evaluations.
Collected: No.
- Category J: Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)).
Examples: education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

- Category K: Inferences drawn from other personal information.
Examples: Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

- Category L: Sensitive personal information.
Examples: Government-issued identifying numbers, financial account details, genetic data, precise geolocation, race or ethnicity, religious or philosophical beliefs, union membership, mail, email, text messages, biometric data, health data, and sexual orientation or sex life.
Collected: No.
Under CCPA/CPRA, Personal Information does not include:
- Publicly available information from government records
- Deidentified or aggregated consumer information
- Information excluded from the CCPA/CPRA's scope, such as:
- Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data
- Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994
Sources of Personal Information
We obtain the categories of personal information listed above from the following categories of sources:
- Directly from You. For example, from the forms You complete on our Service, Your application questionnaire answers, and Manuscripts You submit during the beta phase.
- Indirectly from You. For example, from observing Your activity on our Service.
- Automatically from You. For example, through cookies We or our Service Providers set on Your Device as You navigate through our Service.
- From Service Providers. For example, from Our analytics, hosting, and AI processing providers as part of delivering the Service.
Use of Personal Information
We may use or disclose personal information We collect for "business purposes" or "commercial purposes" (as defined under the CCPA/CPRA), which may include the following examples:
- To operate our Service and provide You with Our Service, including processing Manuscripts for evaluation through Our AI processing partners.
- To provide You with support and to respond to Your inquiries, including to investigate and address Your concerns and monitor and improve our Service.
- To fulfill or meet the reason You provided the information.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
- For internal administrative and auditing purposes.
- To detect security incidents and protect against malicious, deceptive, fraudulent or illegal activity, including, when necessary, to prosecute those responsible for such activities.
- Other purposes consistent with the context in which the information was collected, or as otherwise disclosed to You at the time of collection.
If We decide to collect additional categories of personal information or use the personal information We collected for materially different, unrelated, or incompatible purposes, We will update this Privacy Policy.
Disclosure of Personal Information
We may disclose the following categories of personal information for business or commercial purposes to Our Service Providers (listed in the "Service Providers" section):
- Category A: Identifiers
- Category B: Limited overlap with Category A only
- Category F: Internet or other similar network activity
When We disclose Personal Information for a business purpose, We enter a contract that describes the purpose and requires the recipient to keep that personal information confidential and not use it for any purpose except performing the contract.
Sale of Personal Information
We do not sell Your Personal Information.
As defined in the CCPA/CPRA, "sell" and "sale" mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's personal information by the Business to a third party for valuable consideration.
We have not sold any Personal Information about California residents in the last twelve (12) months, and We do not currently sell Personal Information. If this ever changes, We will update this Privacy Policy and provide opt-out rights as required by law.
Sharing of Personal Information for Cross-Context Behavioral Advertising
We do not share Your Personal Information for cross-context behavioral advertising.
We do not engage in cross-context behavioral advertising. We do not share Personal Information with third parties for the purpose of targeting advertising to You based on Your activity across different sites or services.
Retention of Personal Information
We retain California residents' Personal Information for as long as reasonably necessary to achieve the purposes described in this Privacy Policy. Specific retention periods for major data categories are described in the "Retention of Your Personal Data" section of Our Privacy Policy.
Minors Under 16 Years of Age
We do not sell Personal Information. We do not knowingly collect Personal Information from anyone under the age of 16. If You have reason to believe that a child under the age of 16 has provided Us with personal information, please contact Us with sufficient detail to enable Us to delete that information.
Your Rights under the CCPA/CPRA
The CCPA/CPRA provides California residents with specific rights regarding their personal information. If You are a resident of California, You have the following rights:
- The right to notice. You have the right to be notified which categories of Personal Information are being collected and the purposes for which the Personal Information is being used.
- The right to know/access. Under CCPA/CPRA, You have the right to request that We disclose information to You about Our collection, use, sale, disclosure for business purposes and share of personal information.
- The right to say no to the sale or sharing of Personal Information (opt-out). We do not sell or share Personal Information, so no opt-out is required. See the "Sale of Personal Information" and "Sharing of Personal Information for Cross-Context Behavioral Advertising" sections.
- The right to correct Personal Information. You have the right to correct or rectify any inaccurate personal information about You that We collected.
